Linda Luna and Ayah Altayri v. Top Dawg Entertainment, et al.
UPDATE: Court Rules Against TDE, Grants Plaintiffs’ Motion to Dismiss Certain Affirmative Defenses
Plaintiffs’ Claims Against TDE
Linda Luna and Ayah Altayri filed suit against Top Dawg Entertainment and its executives alleging sexual assault, sexual battery, sexual harassment, and breach of contract. After Plaintiffs filed suit anonymously, TDE disclosed their names to the press, calling it a shakedown lawsuit, resulting in harassment and lost business. In response, Plaintiffs added a doxxing cause of action to the lawsuit.
Judge Rejects TDE’s Attempt to Strike Doxxing Claums
TDE moved to strike Plaintiffs’ doxxing cause of action, arguing that their statement to the press revealing Plaintiffs' identities was protected speech and covered by the litigation privilege. The Court disagreed. Specifically, the Court held that publicly revealing Plaintiffs' true identities was not a necessary part of “correcting the narrative” in the public record. TDE has stated it believes the Court got it wrong and is appealing the Court’s decision.
