Morgan C. Smith is a partner in, and founding member of, the Arns Law Firm. He is respected throughout California as an outstanding trial and appellate advocate. At The Arns Law Firm, Mr. Smith has tried many multi-million dollar cases to verdict, and has obtained four eight-figure verdicts.
Many California attorneys rely upon Mr. Smith’s expertise in construction injury litigation law. He has written numerous articles on the subject, with a specific emphasis on the passage of AB 1127 allowing Occupational Health and Safety regulations into evidence.
Upon request by the California Consumer Attorneys, he wrote the amicus briefs submitted in regard to the construction injury liability cases of Toland v. Sunland Housing Group, Inc. (1998) 18 Cal.4th 253; Hooker v. Department of Transportation (2002) 27 Cal.4th 198; McKown v. Wal-Mart Stores, Inc. (2002) 27 Cal.4th 219; Kinsman v. Unocal Corp. (2005) 37 Cal.4th 659 and Elsner v. Uveges (2004) 34 Cal.4th 915. He also represented the plaintiff in the appeal of Kinney v. CSB Construction, Inc. (2001) 87 Cal.App.4th 28. In Elsner, the seminal case regarding the use of Occupational Health and Safety regulations into evidence in third party cases, the Supreme Court largely adopted Mr. Smith’s briefing on Labor Code §6400 and the duties arising from the section.
